U.S. Citizenship and Immigration Services (USCIS) may forgive the failure to timely file certain visa petitions and applications. To convince USCIS to accept the late filing of a petition or application, our law firm prepares and submits a request for forgiveness through a nunc pro tunc (Latin language, meaning “now for then”) filing. This Nunc Pro Tunc (NPT) solution whereby USCIS accepts a late filed petition or application, is accomplished by proving the following: (1) the late filing is the result of extraordinary circumstances beyond the control of the applicant or petitioner; (2) the person seeking an immigration benefit has not otherwise violated their nonimmigrant status; (3) the person seeking the immigration benefit remains a bona fide nonimmigrant; and (4) the person seeking the immigration benefit is not subject to deportation or removal proceedings.
